Terms of Service

1. Acceptance

By creating an account or using Archvisio (the Service), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms constitute a binding agreement between you and Florian Stangl (we, us), operating Archvisio from Austria.

2. The Service

Archvisio is an AI-powered architectural visualization platform that allows users to generate photorealistic renders from architectural drawings, floor plans, and reference materials. The Service is provided on an as-is basis and features may change over time.

3. Accounts and Access

You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your account credentials. You may not share accounts or allow unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms.

One account per person or company. Team members must be invited through the workspace feature.

4. Credits and Billing

The Service operates on a credit-based system. Credits are consumed each time you generate a render. Credits are non-refundable except where required by law. Unused subscription credits carry over into the next billing period, up to a maximum balance of twice your monthly credit amount. Top-up credits do not expire.

Prices are shown excluding VAT where applicable. Austrian VAT (USt) applies to customers in Austria. EU reverse charge applies to eligible EU business customers.

We reserve the right to change pricing with 30 days notice. Your continued use after that date constitutes acceptance of the new pricing.

5. Your Content

You retain ownership of all content you upload (drawings, images, photos). By uploading content, you grant us a limited, non-exclusive licence to process and store it solely to provide the Service.

You represent that you have the right to use and upload all content, and that it does not infringe third-party intellectual property rights.

AI-generated renders produced by the Service are owned by you, subject to the terms of the underlying AI providers (currently fal.ai, Black Forest Labs, Freepik and Anthropic; our Privacy Policy lists the providers we use).

6. Acceptable Use

You may not use the Service to:

• Generate content that is illegal, harmful, or violates third-party rights
• Circumvent credit limits or billing mechanisms
• Reverse-engineer, scrape, or copy the platform
• Resell access to the Service without written permission
• Upload content that infringes copyright or contains personal data of others without consent

We may remove content and suspend accounts that violate these rules without notice.

7. AI-Generated Content

AI-generated outputs may be imperfect, inconsistent, or not suitable for final construction or planning submissions without professional review. We make no warranty that renders are architecturally accurate representations of any real or proposed building.

You are responsible for verifying generated content before use in any professional context.

8. Availability and Modifications

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may modify or discontinue features with reasonable notice. We will not reduce your remaining purchased credits without a refund or equivalent.

9. Limitation of Liability

To the maximum extent permitted by Austrian law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect, consequential, or incidental damages, including lost profits or loss of data.

10. Termination

You may delete your account at any time from the account settings page. We may terminate or suspend your account for breach of these terms. When an account is deleted, it and every workspace in which the account holder is the only member are hidden immediately and permanently erased after 60 days. During those 60 days you can ask us to restore your account by writing to hello@archvisio.ai. Data we are legally required to keep, such as billing records, is retained for the period the law requires.

11. Governing Law and Jurisdiction

These terms are governed by Austrian law. The exclusive place of jurisdiction is Wels, Austria, to the extent permitted by law. EU consumer protection regulations remain unaffected.
